IFP Challenges Legislature Official's Employment

14 June 2013

The IFP has written to the KwaZulu-Natal Speaker, Peggy Nkonyeni, demanding the release of details regarding the employment of Mr Mpondi who is the Legislature’s Human Relations Manager. In a letter he wrote to the Speaker, IFP Leader in the Legislature Blessed Gwala asked the Speaker to furnish the IFP with details of the media in which the post now occupied by Mpondi was advertised, details of candidates, the panel that conducted interviews and the records of the interviews.

Gwala’s letter follows Wednesday’s heated exchange in the Legislature between the IFP and the Deputy Speaker, Mtholephi Mthimkhulu after Mthimkhulu had found IFP MPL Joshua Mazibuko guilty of deliberately misleading the Legislature. Mazibuko had tabled a Motion which accused Mpondi of expelling staff members and bragging that he had been given the mandate by the ANC to expel any staff member. Mazibuko’s motion had gone further to cite a Mr Baloyi who was allegedly sacked by Mpondi for questioning the employment of a company known as SAP which deals with claims.

When the Legislature ended its business, Mthimkhulu then took the opportunity to deliver a ruling which stated that Mazibuko had misled the Legislature about his Motion. It was that ruling which led to an exchange between him and the IFP Members.

This morning the IFP leader then wrote to Speaker Nkonyeni expressing the IFP’s unhappiness as well as the party’s intention to pursue the matter further. Gwala’s letter read as follows:

“13 June 2013

Hon. Ms NP Nkonyeni, MPL

Speaker: KwaZulu-Natal Legislature

239 Langalibalele Street

PIETERMARITZBURG 3201

Hon. Speaker

COMPLAINT AGAINST DEPUTY SPEAKER’S HANDLING OF HON. MJ MAZIBUKO CASE AND REQUEST FOR RELEVANT INFORMATION

On behalf of the IFP Caucus, I wish to express our disquiet with the attitude of the Deputy Speaker, Hon. M. Mthimkhulu when he handled the case against Hon. MJ Mazibuko in the Legislature. In fact we are not even certain if the whole procedure which finally led to his ruling was proper. In our view, the Deputy Speaker’s attitude was confrontational and his ruling left much to be desired.

For the Speaker’s benefit, let me state that the Deputy Speaker made a ruling in a matter emanating from a Motion tabled by Mazibuko, the gist of which was about allegations of Mr Mpondi’s unbecoming conduct.

As the IFP, we intend to pursue the matter further either with your Office or through other means. To this end, we would like the Office of the Speaker to furnish us with the following documents and/or information:

a) The Hansard dealing with this whole matter

b) Details about Mr Mpondi’s employment; particularly:

i) Whether or not Mr Mpondi’s post was advertised?

ii) If it was advertised, to please furnish us with evidence of the media in which advertisements for the post were run

iii) The names of all who responded to the adverts and their CV’s, as well as names of those who were finally selected for interviews and their CV’s

iv) The panel which conducted the interviews

v) Copies of the minutes and/or details of all interviews, including how each candidate performed

vi) And all other documents or information that may be pertinent to this matter

It is very crucial that the IFP Caucus receives all this information so that we will be able to plot the way forward.

Looking forward to the Hon. Speaker’s positive response to our request;

Yours sincerely

MB Gwala, MPL

LEADER OF THE OFFICIAL OPPOSITION”
